In accordance with and pursuant to Article 13 of Regulation (EU) No. 679/2016 (hereinafter the “Regulation”), SENINI S.r.l. (hereinafter the “Company”) provides the following information on the processing of personal data of its Clients (hereinafter the “Data”) carried out by the Company as the Data Controller.
1) Data Controller and contact information pursuant to Article 4 of the Regulation:
The Company is the Data Controller of the Data relating to its Clients.
For communications or requests, the Company can be reached by email at senini@senini.it.
Pursuant to Articles 37 and subsequent of the Regulation, the Company has appointed a Data Protection Officer (hereinafter the “DPO”), who can be reached at cristinagaspari@senini.it.
2) Categories and types of Data collected and processed:
The Data processed by the Company may include common data collected for the purpose of concluding the contract with the Client and/or in the course of its execution and/or stipulation. It is also possible that the personal data of third parties communicated by the Client to the Company may be processed. In such cases, the Client acts as an independent data controller and assumes the resulting legal obligations and responsibilities, indemnifying the Company against any disputes, claims, and/or compensation requests arising from the processing that may be brought against the Company by third parties.
3) Purposes of data processing
A) Without your explicit consent (Art. 6 lit. b, e) of the GDPR for the following purposes:
- To conclude contracts for the services of the Data Controller
- To fulfill pre-contractual, contractual, and tax obligations arising from ongoing or upcoming relationships with you (e.g., requests for quotes for goods and services)
- To comply with legal obligations (e.g., anti-money laundering or tax reporting)
- To exercise the rights of the Data Controller (e.g., the right to defense in court or debt recovery)
B) Only with your specific and separate consent (Art. 7) of the GDPR for the following marketing purposes:
- To send you newsletters, commercial communications, and/or advertising material on products or services offered by the Data Controller via email, post, SMS, and/or phone calls, and to gauge your satisfaction with the quality of the services provided;
- To send you newsletters, commercial communications, and/or promotional materials from third parties (e.g., business partners, insurance companies, other group companies) via email, post, SMS, and/or phone calls.
Please note that if you are already one of our clients, we may send you commercial and informational communications about services and products offered by the Data Controller as we have done so far unless you exercise your right to be removed from our communication database.
4) Methods of Data Processing
For the purposes mentioned in point 3, the processing of personal data is carried out using paper, electronic, and telematic tools, following strictly related logic and ensuring the security and confidentiality of the data.
5) Duration of Data Processing
For the purposes mentioned in point 3, personal data is processed for a period defined by a declared or logically explicit timeframe or by law, and in any case, not longer than 10 years after the end of the relationship for service purposes and no longer than 2 years from the data collection for marketing purposes. The data subject has the right, where possible, to request deletion at any time (right to be forgotten).
6) Data Provision
Without prejudice to the data subject’s autonomy, the provision of personal data may be:
a) mandatory under law, regulation, or community legislation;
b) strictly necessary for establishing new relationships or managing and executing existing legal relationships;
c) optional for carrying out information and commercial promotion activities for products towards the data subject.
7) Entities that may access personal data (Art. 6 lit. b, c of the GDPR)
a) Personal data may be disclosed—for the purposes stated in point 3, letter A)—and subjected to processing for the same purposes or when required by law, to supervisory bodies, judicial authorities, agent networks, factoring companies, credit institutions, debt recovery agencies, credit insurance companies, professionals and consultants, transportation companies, solely to protect credit and better manage our rights related to each commercial relationship;
b) Personal data may be disclosed—for the purposes stated in point 3, letter B)—to companies in the group (parent companies, subsidiaries, and affiliates, even indirectly), suppliers, contractors, or third-party agents as required by applicable law. When we use suppliers, contractors, or third-party agents, personal information remains under our control, and we have systems in place to ensure that the information is adequately protected.
c) Personal data will be processed exclusively by authorized personnel assigned within the specifically identified offices, and it will not be arbitrarily disclosed beyond the scope described above.
8) Rights of the data subject
Finally, we inform you that Articles 15-21 of the GDPR grant data subjects the exercise of specific rights (e.g., the right of access, rectification, erasure, restriction of processing, data portability, opposition), as well as the right to file a complaint with the Supervisory Authority.
